Can an Ontario online casino legally operate without being registered under the provincial iGaming framework?

Just as a bar can't serve without a liquor licence, an online casino can't legally take bets from Ottawa players without clearing both the AGCO and iGaming Ontario hurdles. And the AGCO is explicit about what happens if registration lapses: you can't operate an igaming site if you aren't registered.

What "fully registered" actually means

Being a fully registered and authorized operator in the igaming market means the organization has successfully received a registration by the AGCO and, with the exception of OLG.ca, has executed an operating agreement with iGO. To complete these steps, these organizations will have met rigorous standards of game integrity, fairness, player protections and social responsibility. The process also requires technology certification by an independent testing lab, implementation of the AGCO's Registrar's Standards for Internet Gaming, and an independently audited assessment of controls — all registered internet gaming operators will be required to submit an independently audited assessment of the processes and controls that they have in place to meet the Registrar's Standards for Internet Gaming.

The framework also bites downstream: as of October 31st, 2022, a standard requires registrants and applicants to cease any unregulated activities in the Ontario igaming market. Operators and gaming-related suppliers must cease all gaming activities in Ontario's igaming market if, to carry out those activities in iGaming Ontario's regulated online lottery scheme, it would require registration under the GCA. In other words, a registered operator can't quietly run a parallel unregistered product on the side either.

How to tell whether a site is legitimate

A directory of all fully registered and authorized operators and their igaming sites is available via the iGaming Ontario website — that's your primary check. Every site on that list has cleared the AGCO registration and signed the iGaming Ontario operating agreement. As a quick visual signal, fully registered Ontario sites display both the iGaming Ontario logo and the BetGuard logo; per iGaming Ontario, seeing those logos tells you the site is managed by iGaming Ontario and regulated by the AGCO.

Any site targeting Ottawa players that isn't on the iGaming Ontario registry is operating outside the provincial framework — regardless of what offshore licence it might claim. Those sites carry none of the player protections that registration requires: their sites will have controls preventing underage access and measures to enable more responsible gambling. They have entered legal agreements ensuring compliance with applicable laws, including anti-money laundering. Unregistered operators have made none of those commitments to Ontario players.
